The working model for the Alarcon Group, LLC is inspired by The Magnum Group. The Magnum Group was a group of mid 20th century photojournalists for Life Magazine and National Geographic Magazine. Each held very special talents, educational backgrounds and career experience. Working together, they created a sum greater than its parts.

Similarly, The Alarcon Group has, assembled a vast knowledge and reference base. Our methods incorporate highly recognized and clearly defined alternative dispute resolution practices and processes. Our backgrounds include legal, business, and training experience at local, regional, national and international levels. We have developed working relationships with legal, social and academic resources to support the development and delivery of superior, practical and contemporary dispute resolution results. We serve corporations, small businesses, individuals and those seeking private and personal mediation.

We are frequently called upon to provide instruction throughout the United States. This we deliver broadly to organizations large and small, judiciary systems, legal communities, and public and private, for profit and not for profit, organizations. The Alarcon Group is a diverse group. We hail from different countries, many regions and ethnic groups, and speak several languages. As importantly, our backgrounds, life and career experience are diverse, rich and robust. Some of the group have medical backgrounds, some social science, some employment, some government, financial services, regulatory and compliance, a good part have family law backgrounds, and most have had a long career mediating the litigated case or litigated as attorneys.

Often our resources and backgrounds are blended in collaboration or even co-mediation so that we advance the best possible dispute or conflict resolution process.

Carlos J. Alarcon

Carlos J. Alarcon has over thirty years of successful business experience in mediation, negotiation and risk management. He has focused on the energy, government, and financial services sectors, practicing both in for-profit-and not-for-profit organizations.

Mr. Alarcon has over 2000 hours of mediation experience and well in excess of 500 matters resolved. He has attained both Senior Mediator and Senior Negotiator status.

Mr. Alarcon is an instructor on various elements of mediation and negotiation and is on the faculty of a number of national training organizations.

Mr. Alarcon continues his own educational development in Conflict Resolution having attended Columbia University, Stanford University, University of California, Berkeley and the Straus Institute for Dispute Resolution, and the Sedona Conferences on E_Discovery and Electronically Stored Information Dispute Resolution since 2002.

Mr. Alarcon is recognized nationally in academic and financial circles for his thorough and innovative work and is acknowledged as a thought leader in conflict resolution and decision-making analysis.

Ursula Duncan

Ursula Duncan is passionate about helping people improve their relationships, achieve their goals and live their dreams.

Ms. Duncan is a Professional Coach, Counselor, Mediator, and Workshop Facilitator, who works with everyone from teens, couples and older adults to business leaders and CEO's.

To date, she has worked with over 650 clients and has mediated over 280 cases (from two-party to multi-party cases), with 98% ending in sustained resolutions.

Ms. Duncan also serves as an active Senior Mediator at Peninsula Conflict Resolution Center and City of Mountain View Mediation Program where she has mediated for 13 years. Twice a year for 13 years she has co-instructed a forty-hour mediation certification class at Foothill College in Los Altos Hills and continues to do so.

BACKGROUND

Ms. Duncan began her "non-academic" study of communication mediating between family members and people of diverse races and cultures. She grew up in a family with four nationalities and lived in five countries by the time she was 14. She got a lot of practice understanding different values, cultures, and communication styles.

Ms. Duncan continued her education focusing on interpersonal communication at UCSB where she graduated Phi Beta Kappa and earned a B.A. with High Honors and Distinction in Communication Studies and German (1984). After working as a Marketing Manager in two publishing companies, she returned to school to get an MBA from Stanford, with an emphasis on Organizational Psychology (1994). For three years after graduate school she worked as a Coach and Organizational Consultant with the consulting company of best-selling author and Stanford Business School Professor, Dr. Jerry Porras.

In 1994, she was introduced to the Nobel Peace Prize Nominee and international mediator, Dr. Marshall Rosenberg, and began study of his model of communication called Compassionate/Nonviolent Communication (NVC). Three years later she began using NVC as a Volunteer Life Skills Facilitator in a halfway house in San Francisco, as a Community Mediator, and as a Workshop Facilitator. Ms. Duncan gets rave reviews as a workshop facilitator. A recent attendee to one of her NVC one-day intro immersion workshops enthused: "Ursula's workshop gave me hope that there are high quality trainers who can spread NVC long after Marshall (Rosenberg) is gone." Another said: "Ursula hovers on a level near Dr. Rosenberg."

At a recent workshop Dr. Rosenberg himself gave, he joked with the crowd: "Ursula has gone to more of my workshops than I have!" She is grateful to have studied so much with this world-renowned peacemaker, and is delighted to have found her life purpose through coaching and practicing NVC, both personally and professionally, with people vastly improving their relationships - both professional and personal.

She thinks NVC makes the difference between mediations that reach an impasse and those that don't. NVC allows for the disputants to feel heard and come to durable, mutually beneficial agreements. Ms. Duncan finds NVC brings similar benefits to all system interventions whether these are with couples and families or companies and nonprofits.

Ms. Duncan is currently coaching clients with one of the world's most preeminent coaches, Dr. Marshall Goldsmith. He is author of many books on the NY Times best-seller list. His recent book, What Got You Here, Won't Get You There was #1 on the Wall Street Journal and the USA Today best-seller list in the business category in 2008. She is learning Dr. Goldsmith's model of coaching which has a strong track record in getting robust, long-term results.

Ms. Duncan volunteers for Challenge Day, which brings one-day workshops into Middle Schools and High Schools nationwide. These deal with issues like bullying, gangs, depression, eating disorders, and teen suicide. Most schools report remarkable progress with such issues afterwards.

Ms. Duncan volunteers for Green at Home in Menlo Park and Palo Alto. This organization helps residents in these cities make their homes and habits greener, using less energy and water for a healthier planet.

Kathryn Ely

Ms. Ely has been working in the field of ADR since 1990. She holds a Master's in Behavioral Science and has accumulated 375 hours of mediation training and has mediated approximately 2000 cases.

Ms. Ely has achieved the Advanced Practitioner designation from the Association of Conflict Resolution.

Kathryn specializes in workplace disputes including EEO claims, labor-management matters and employment disputes. She has served various federal agencies as an external mediator including the U.S. Equal Employment Opportunity Commission, the Department of Homeland Security, Bureau of Land Management and the U.S. Postal Service. Kathryn also serves on the panel of external mediators for Northern Nevada and California district courts mediating child custody and visitation cases.

Kathryn offers mediation and facilitation trainings, as well as consultations and assistance for private sector organizations in designing and implementation of ADR mechanisms and programs.

William Mooser

Mr. Mooser is currently conducting mediations for East Bay Community Mediation in the Hayward Superior Court - Civil, the Oakland Superior Court - Civil and community mediations through their offices. As a licensed general contractor since 1974, Mr. Mooser brings forth both the understanding of that field, as well as, the skills needed to help people resolve their conflicts in the sensitive area of maintaining their homes. Mr. Mooser has expanded his mediation practice to include training on the subject of mediation in general and, more specifically, resolving construction disputes. Mr Mooser is the current President and a Member of the Board of Directors of the Association for Dispute Resolution of Northern California.

Yu Yee Wu

Ms. Wu offers significant experience in litigating employment cases involving federal and state employment laws such as Title VII, the ADA, the Rehabilitation Act and FEHA. She has also litigated personal injury and consumer class action cases. ??Ms. Wu seeks to advise and counsel individuals, public, or private entities on their rights and obligations under the law and the legal remedies available to address their needs. Ms. Wu specializes in mediating and litigating Employment litigation (federal and state) Additionally, she is adept at implementing and drafting of regulations and policies for the Division of Workers' Compensation; related litigation defense; management of ADA accommodations issues. Ms. Wu is a member of and has served on the Board of Directors at the Asian American Bar Association and currently serves on the Board of Directors of the Association for Dispute Resolution as Co-Chair of the Diversity and Equity Committee.

Juan Dominguez

Mr. Dominguez specializes in the fields of Workplace Conflict and as an Intervention Specialist. He has expansive experience as a union official and representative. The main body of Mr. Dominguez's experience and work and as a mediator has been with the United States Postal Service and as such has significant expertise with EEOC matters. Mr. Dominguez also works as a mediator with the Solano Superior Court - Civil, where he practices most often in Small Claims and Small Claims Appeals.

Dr. L. B. Heatley

Dr. Heatley specializes in medical practice disputes at both the class action level and at the individual consumer level. Dr. Heatley has extensive experience engaging and in outreach with the public as part of her practice.
